The Burney Company SMS / Text Messaging Terms of Use

These SMS Terms of Use (“Terms”) govern the use of text message (SMS) communications between The Burney Company (“Company,” “we,” “us,” or “our”) and our clients. By providing your mobile telephone number and consenting to receive text messages from The Burney Company, you agree to be bound by these Terms.
1. Scope of SMS Communications
The Burney Company uses SMS/text messaging exclusively for client identity verification purposes. Text messages sent by the Company are strictly limited to:

One-time passcodes (OTPs) to verify your identity during account access or login;

Verification codes required to authenticate a client transaction or request;

Confirmation messages related to identity verification workflows.
The Company does not use SMS messaging for marketing, promotional offers, newsletters, or any communications unrelated to client verification.
2. Consent and Opt-In
By providing your mobile phone number to The Burney Company and requesting or completing a verification action, you expressly consent to receive text messages for identity verification purposes. Consent is not a condition of purchase or receipt of any service.
3. Message Frequency
You will only receive a text message once per verification request when a verification event is initiated by you or on your behalf. The Company will not send unsolicited messages.
4. Message and Data Rates
As always, standard message and data rates may apply to messages sent to you by us and from us to you, depending on your mobile carrier plan. The Burney Company does not charge a fee for SMS verification messages; however, your wireless carrier may charge for incoming or outgoing text messages. If you have any questions about your text plan or data plan, it is best to contact your wireless carrier about applicable fees.
5. How to Opt Out
You may cancel the SMS service at any time. Just text "STOP" to the number. After you send the SMS message "STOP" to us, we will send you a confirmation SMS confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, sign up as you did the first time, and we will resume sending SMS messages to you.
6. Supported Carriers
SMS verification messages are available through most major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, and Sprint. Delivery is not guaranteed across all carriers or devices. Carriers are not liable for delayed or undelivered messages. The Company is not responsible for undelivered messages due to carrier issues, network outages, or device incompatibility.
7. Privacy and Confidentiality
Your mobile phone number and any information transmitted via SMS will be handled in accordance with The Burney Company's Privacy Policy (https://burneywealth.com/privacy-policy). We will not sell, rent, or share your mobile number with third parties for their own marketing purposes. Verification codes are confidential — do not share them with anyone, including individuals claiming to represent The Burney Company.
8. Security
Verification codes are single-use and expire within a limited time window. If you receive an unexpected verification code, do not use it and contact The Burney Company immediately. The Company will never ask you to provide a verification code verbally or through any communication channel other than our secure verification interface.
9. Modifications to These Terms
The Burney Company reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and/or provided to clients through appropriate notice. Continued use of SMS verification services following notification of changes constitutes your acceptance of the revised Terms.
